What Can I Expect?

First time offenders can generally expect to pay a fine and court costs, possibly serve time on probation, and perhaps some other conditions, such as taking a class or performing some community service. How Does Probation Work?

Probation is a common condition to reduce fake ID violations. For first time offenders, chances are you will not have to report to a probation officer, but you will need to stay of out trouble during the probation period, which can generally be anywhere from six months to two years.

Also, there are two kinds of probation: Suspended imposition of sentence (SIS) and suspended execution of sentence (SES).

With suspended imposition of sentence, you plead guilty to the reduced charge, but the court does not issue a sentence and the offense is generally removed from your record entirely after probation if you don’t get into trouble again.

With suspended execution of sentence, you plead guilty to the reduced charge and the court imposes a sentence of imprisonment. But it does not execute that sentence, so you don’t have to serve your sentence if you stay out of trouble during the probation period. However, unlike a suspended imposition of sentence (SIS), a suspended execution of sentence is a conviction and will stay on your record.

Both SIS and SES can be helpful. But if you violate the probation by getting in trouble again, the consequences can be severe. With a suspended imposition of sentence (SIS), the court will consider the new charge when it sentences you for the one for which you were placed on SIS. With a suspended execution of sentence (SES), you have already agreed to the sentence when you accepted the SES, so you will generally have to serve it.
